This Privacy Policy covers the websites www.photoloom.com and
www.familyphotoloom.com (collectively the “Site”), which are owned and
operated by Photoloom LLC (“Photoloom,” “we” or “us”) and all Photoloom
services provided on the Site (the "Service"). By visiting the Site,
submitting information or using the Service, you (and the group, company, or
other entities you represent) are accepting the practices set forth in this
Privacy Policy. This Privacy Policy does not apply to the practices of third
parties that Photoloom does not own or control. Please contact us with

Photoloom is deeply committed to protecting your privacy. We recognize the
potential sensitivity and confidentiality of the Content that you may enter
or upload to the Site, and we have implemented this Privacy Policy to
provide our registered users ("Site Members" or “you”) and unregistered
users and visitors information (“Users” or “you”) regarding the collection
and use of information, so that you can make an informed decision about your
use of the Site.
Personal Information You must register with the
Site to use the Services. Registered users of the Site are “Site Members.”
As a Site Member, you have your own Family Photoloom Account (Account) on
the Site. To become a Site Member, you must select a username and password,
and provide us with your name and a valid and active email address for
confirmation of your Account. It is your sole responsibility to maintain the
accuracy of your registration information.
Your Family Photoloom
Account is designed to be private. To protect your privacy and security, we
take reasonable steps (such as requesting a password) to verify your
identity before granting you access to your Account. You are responsible for
maintaining the secrecy of your password and other account information at
all times. Your password is encrypted on our server, so no one, including
Photoloom, has access to it. If you forget it, it will need to be reset.
Only you and those you have approved as Guests of your Account can view
your Account. Guests may or may not also be able to Edit and/or Link to
Content in your Account, but Edit and Link privileges to your Account are
exclusive, and can be granted by only you.
We may use the email
address that you have provided to us to send email to you, including among
other things notices required by law, in lieu of postal mail. You may not
opt out of Service-related emails.
We may also send you other email
messages (e.g., information about changes or additions to Photoloom service,
products and special offers). You may opt out of receiving such emails by
sending an email to support@photoloom.com. You may also opt out by sending
regular mail to the address found at the end of this Privacy Policy.
We will not provide any Site Member's personal information to advertisers or
third parties, except to those third party affiliates listed on the Site as
needed for the fulfillment of services. This includes your email address and the email addresses of
those you invite.
We will not spam you or your relatives or anyone
else.
We will not allow your account to be publically searchable.
Only you and your Guests can search within your Account or view its
Contents.
We will not share the Personally Identifiable Information
that you may provide when taking advantage of promotions, responding to
surveys, or subscribing to newsletters or other lists with advertisers or
third parties.
We have taken industry standard security measures to
protect your Content and the personal information that is in our control
from accidental loss and/or unauthorized access, use, alteration, or
disclosure. We make good faith effort to ensure the integrity and security
of our network and systems to store the non-public information collected by
the Site in a secure operating environment that is not available to the
public; nevertheless, Photoloom cannot guarantee that our security measures
will prevent third-party “hackers” from illegally accessing our site or
using your Account Content for improper purposes.
Credit Card &
Purchasing Information
Site Members who wish to upgrade
their Accounts or purchase Photoloom Family Charts and other gifts from
the Site will be asked to submit financial information such as their
credit card number. Photoloom does not collect, handle or store
your credit card information. Payment is accepted and processed through
Cybersource, a merchant service provider. All payment data is captured,
processed and stored within CyberSource’s security-certified processing
network.
Cybersource
is a leading provider of commerce processing services to thousands of online
businesses, and has been certified to be compliant with the Visa Cardholder
Information Security Program (Visa CISP) since the program's inception in
2002. Visa CISP is the bankcard industry's most stringent security standard.

Non-Personally Identifiable Information In addition to
the personal information you may provide to us, some non-personal
information is automatically collected. This non-personal information is not
associated with your identity, and is used to evaluate how our Site is being
used. The technologies we use to gather this non-personal data include IP
addresses and web logs. This data is used primarily to:
* Access your
information after you sign in.
* Improve the quality and design of
the Site and to create new features and services.
* Gather broad
demographic information, such as the geographic distribution of Site users,
total number of visitors, and traffic.
* Diagnose or fix technology
problems.
* Aggregate general user and Site Member statistics
including demographic and geographic information.
* Other purposes
for which your personal identity is not revealed.
Use of Cookies
A cookie is a piece of data stored on a user’s computer tied to information
about the user. Photoloom does not use cookies to collect private
information that a user did not intentionally submit to us. We do use a
third-party tracking service that uses their own cookies to track
non-personally identifiable information about visitors to our Site in the
aggregate to help us improve the quality of service. This non-personally
identifiable information includes, but is not limited to; page views,
referring websites, time spent on the site and exit points. Site Members may
optionally use a cookie to remember their password in order to automatically
log-in to their Family Photoloom account.
Affiliate and/or Advertisers The Site contains links to other websites. Please be
aware that Photoloom is not responsible for the terms of service, privacy
practices, security, or content of other websites. These TOS apply solely to
the Site.
Other websites may provide links to the Site. Photoloom
has not reviewed all of the websites linked to the Photoloom Site, and is
not responsible for the content of any off-site pages or any other sites
linked to this site.
If you click away from
the Site to visit the site of any third party advertiser or sponsor, you may
be asked for personal information in order to purchase or use products and
services offered. These companies have their own privacy policies and data
collection practices. Photoloom has no responsibility or liability for these
independent policies. You should therefore review their privacy policies
carefully if you have concerns about how your information may be used.
International Users The Site is hosted in the United States and is
intended for and directed to users in the United States. Photoloom makes no
representations that the Site is appropriate or available for use in other
locations. The Site and Services are void where prohibited. If you are
accessing the Site from outside the United States, you do so at your own
volition and your use of the Site is governed by U.S. law; you are
transferring your personal information to the United States, and you consent
to that transfer.
Account Guests As a registered
Site Member, you may invite Guests to visit your Account on the Site;
however, each of your Guests must register as a Site Member with their
own username and password. By inviting another Site Member to be a Guest
on your Account, you allow them to view the Contents of your Account.
Trial Accounts are limited to 10
Guests.
Guest Privileges (Guest privileges are not reciprocal and
may be rescinded at any time) When you invite a Guest to your account,
they are automatically given "View" privileges, which simply means that they
may look at the Contents of your Account. A Guest with only View privileges
may not add or change Content to your Account. You may choose to allow
individual Guests the privilege to “Edit” your Account Content. If you give
a Guest "Edit" privileges, he can add images and other content, and make
changes to your account.
Storing Linked Images If you link images
from another account to your own, the storage space required for that Image
is added to your account storage use. As a result, even if a Premium Account
from which you linked the Image reverts to a Free Trial Account and the
down-grade results in an Image to which you have linked becoming
inaccessible to the original account owner (or for any reason the account
from which the Image is linked closes), that image will continue to be
available on your account. (In other words, for example, you won’t lose the
picture of Aunt Ruth that you linked to from Cousin Emilia’s Account, even
if Cousin Emilia’s Account down-grades or closes.)
Guest privileges
are not reciprocal and may be rescinded at any time. For example, even if
you grant Edit privileges to another Site Member, that Site Member must
grant you Edit privileges in order for you to edit their Account. Any and/or
all Guest privileges may be rescinded by the Account owner at any time;
however, any Images that are linked prior to the rescission will continue to
be linked.
Children’s Privacy Protecting the privacy of young
children is very important to Photoloom – and it is mandated by U.S. law.
For these reasons, Photoloom does not knowingly allow any person under the
age of 13 to register as a Site Member; nor do we knowing collect Personally
Identifiable Information on the Site from any person under 13 years of age.
Changes to This Privacy Policy Photoloom may revise this Privacy
Policy at any time, at our sole discretion; this will be reflected in the
"Effective Date" above. Your use of the Site indicates your acceptance of
this Privacy Policy and any then-current revisions.
Legal Disclaimer
Without limiting the foregoing, we reserve the right to disclose your
personal information as may be required by law or judicial process, or if we
in good faith believe that disclosure is necessary to protect our rights. We
reserve the right to collect and share any information in order to
investigate, prevent, or take action regarding suspected or actual illegal
activities, and/or as appropriate or necessary to enforce our Terms of
Service or investigate potential or actual violations of our Terms of
Service or Privacy Policy. We reserve the right to collect and share
information to take precautions against liability, to protect the security
or integrity of our Site, and/or to exercise or protect the rights,
property, or the rights and personal safety of Photoloom affiliates, Site
Members, Users or others; or for other legitimate purposes.

Photoloom after modifications to this Privacy Policy are posted, you are
agreeing to accept the Privacy Policy as modified. Please contact us with
